The former legal officer for Fujitec opened up accounts with local banks in the names of phony law firms to swindle more than $150,000 over three years from his Mason-based employer.

But when it came time for sentencing in a Warren County courtroom, Courtney thought 90 days in jail was too much time.

After getting a plea deal with prosecutors, he tried to strike another deal with the judge.

Courtney asked if he could get out of jail in 30 days if he paid Fujitec the $5,000 the judge ordered by then. He said he didn’t think he could stand being away from his three sons for 90 days.

Judge Donald Oda II gave a firm “No” in return.

“That’s part of your accepting responsibility, paying the price and that includes you being away from your children,” Oda said. “It’s an unfortunate fact for your children because they didn’t do anything. But for you, that’s part of this. You are going to do the 90 days in jail.”

Oda had allowed Courtney to leave the Warren County Jail for work on the 90-day sentence. He also sentenced him to electronically monitored house arrest for six months after Courtney is released.

Oda threatened to send Courtney to prison for 36 months if he doesn’t start paying the $5,000 to Fujitec. That amount represented the company’s insurance deductible on their claim to get the money that Courtney stole.

He will be on probation for three years after his sentence is completed.

Courtney pleaded guilty to one felony charge of aggravated theft in March. In exchange, felony charges of aggravated theft, telecommunications fraud and tampering with records were dismissed.

Authorities said Courtney created fake claims from around the country and would then have Fujitec issue checks to the phoney law firms who were supposedly representing the claimants in efforts to settle those claims.

Courtney lost his job at Fujitec after the thefts, from 2010 through February 2013, were discovered.

His attorney, Jim Hardin, said Courtney has since started his own construction, carpentry and contracting company and also works for Office Depot. He’s also trying to obtain a Realtor license so he can work as a property manager, Hardin said.

Courtney will lose his law license because of the felony conviction. His case must be reviewed by the Ohio Supreme Court’s disciplinary system before that happens.

Oda hammered that point home before Courtney was taken to jail.

He noted that Courtney had not only violated violated a position of trust at Fujitec, he did the same to his fellow legal professionals.

“It goes without saying. You are not to be practicing law any more at all,” Oda said.

Free seminar addresses theft from nonprofits

Warren County law enforcement officials will hold a free accounting seminar Thursday, April 25 to help nonprofit organizations and clubs prevent theft.

Local attorney and accountant Tom DuPois will lead the seminar, set for 7-9 p.m. at the Warren County Administration Building, 406 Justice Drive, Lebanon.

The meeting will focus on ways board members, officials, directors and leaders of community organizations can implement internal controls and procedures regarding the handling of money.

The event, sponsored by Warren County Prosecutor David Fornshell’s office and the Warren County Police Chiefs Association, comes on the heels of theft convictions of two former officers of Springboro youth sports organizations.

In February, a judge sentenced Michele Petrey, of Springboro, to three months in jail after she admitted to stealing more than $65,000 from the Clearcreek Youth Soccer Association.

Petrey, 44, served as the organization’s treasurer from 2008 to 2012, during which time she made 101 unauthorized payments to such businesses as Kohl’s, Discover, American Express, Capitol One and Discover..

Last week, Thomas Harves, of Springboro, pleaded guilty to stealing more than $400,000 over the past eight years from the Springboro Athletic Boosters Association.

Harves, 61, served as treasurer of the organization for more than 20 years. He faces up to 5 years in prison and a $10,000 fine when he is sentenced June 11.

“There’s no doubt in my mind that its rampant,” said Fornshell of internal theft amongst nonprofit and community organizations. “Whenever you give people the opportunity to handle money, there’s a chance they will steal.”

A West Chester woman has pleaded guilty to stealing more than $23,000 from her Mason employer.

Marcie “Allison” Denney, 37, pleaded guilty Friday to one count of theft, a fourth-degree felony, and four fifth-degree felony counts of forgery.   She originally faced one count of theft and nine counts of forgery.

Between August and November last year, Denney forged 25 company checks from her employer, JKrete, a Mason company specializing in traditional and decorative concrete installation, totaling more than $23,000.

Denney cashed company checks and wrote checks out to a friend, Christine Inman.  Inman, 30, of West Chester, has been charged with one count of receiving stolen property and one count of forgery, both fifth-degree felonies.

Company owner Bruce Mills said Denney first started at a temporary worker in January and was hired on in April as an office receptionist.  In that role, she handled incoming checks and outgoing bills.

Suspicions were first raised after Inman allegedly attempted to cash a company check and a cautious Fifth Third Bank teller called him to verify the signature, Mills said.  He froze the account and discovered other forged checks by Denney.  Mason Police arrested her at work the next day.

“She’s a serious con artist,” he said.  “She is very sneaky, conniving and manipulative, and she will do it again and again.”

Alleged retail theft ringleader indicted

A Warren County grand jury Friday indicted an Oakley man who police say served as the ringleader of a retail theft operation that resold stolen personal care items at a local flea market.

Jeremy Barrett, 32, faces charges of receiving stolen property, a fourth-degree felony, and misdemeanor charges of theft and receiving stolen property.

Police say Barrett hired Bonnie Coldiron and Farrah Jones to boost personal care products from local Walmart stores, which he then resold at a local flea market.  It is unclear which flea market Barrett operated at.

The alleged crimes came to light after Warren County Sheriffs deputies were dispatched to a theft in progress at the Deerfield Township Walmart on Feb. 14.

Store security reported observing two female shoplifters stealing over-the-counter medications, razors, deodorant and body spray.  When they apprehended the women, the pair fled the store.  One of the women, Bonnie Coldiron, was observed getting into a van police later determined to be operated by Barrett.

Deputies located the vehicle and conducted a traffic stop.  They apprehended Jones hiding nearby, according to the police report.

Police say they found six boxes of the heartburn medication Prilosec in Coldiron’s purse valued about $262.  They did not locate Jones’ purse or items she allegedly stole, according to the police report.

Upon a search of the vehicle, police say they recovered more between $20,000-$30,000 of personal care products stolen from local Walmart stores.

“(The deputies) were stunned when they opened that van up and saw the amount of property back there,” said Warren County Sheriff’s Sgt. Brandon Lacy.  “It took them hours just to inventory it.”

Police: Woman stole $18,000 from Mason employer

A West Chester woman has been indicted for stealing more than $18,000 from her Mason employer.

Mary Doyle, 50, faces two counts of theft, both fourth-degree felonies. The Warren County grand jury announced the indictments Monday.

Police say Doyle worked for Nationwide Insurance on Snider Road in Mason. A LinkedIn profile in Doyle’s name indicates she was hired in January 2011 as an administrative assistant with the company.

According to police reports, Doyle allegedly made more than $18,000 in non-business personal purchases on a company credit card from August 2011 through October 2012.

Company officials say they discovered the charges after conducting an internal audit.

Doyle faces up to 36 months in prison and a $10,000 fine if convicted of the charges.

3 indicted for using stolen credit cards

A Warren County grand jury has indicted three New Orleans men, accusing them of using stolen credit numbers to purchase gift cards from Wal-Mart stores in Franklin, Lebanon and Mason.

The alleged crimes happened Dec. 18-20.

Darrin Barra, 20, Ronald B. Washington, 21, and Tevin T. Young, 22, face various charges including forgery and receiving stolen property that are felonies.

Washington was also indicted one first-degree misdemeanor count each of theft and misuse of credit cards. The indictments were announced Monday.

Police: Employee forged $23,000 in company checks

Two West Chester women were arraigned Friday in Warren County Common Pleas Court on charges related to check forgery and theft.

Marcie A. Denney, 37, faces one count of theft, a fourth-degree felony, and nine fifth-degree counts of forgery.

Christine Inman, 30, is charged with one count of receiving stolen property and one count of forgery, both fifth-degree felonies.

Police say that between August and November last year, Denney forged 25 company checks from her employer, JKrete, a Mason company specializing in traditional and decorative concrete installation, totaling more than $23,000.

Denney is accused of both cashing company checks and writing checks out to Inman.

Both women were released on their own recognizance.

Can you help identify this Mason hotel thief?

Mason Police is seeking the public’s help in locating a man wanted for stealing cash from a Mason hotel.

Police say a man entered the lobby of the Hampton Inn on Beach Blvd. in Mason around 6 a.m. Jan. 17 and removed cash from the unattended register.  The suspect is described as a white male, wearing blue jeans and a dark shirt.

Those with information are asked to call Mason Police Officer Nathan Ketterer at 513-229-8560 or Crimestoppers at 513-352-3040. All calls can be made anonymously and tipsters may be eligible for a cash reward.

Alleged credit card thief’s mom leads police to arrest

An alleged credit card thief is in Hamilton County Jail after police received help from an unexpected source: his mom.

Cincinnati Police arrested James Barton, 23, in Westwood Tuesday evening after following his mother.

Barton is accused of stealing credit cards from medical facilities in Warren, Butler, Clinton, Montgomery and Hamilton counties and then using them to buy expensive electronics.

Numerous agencies, including Warren County, are preparing charges of forgery, misuse of a credit card, receiving stolen property and theft, said Warren County Sheriff’s Detective Susan Horne.

Sgt. Eric Vogelpohl of Cincinnati Police Department’s investigative unit said police received a tip through Tristate Crime Stoppers and began following Barton’s mother Tuesday afternoon.

Police followed her for about two hours as she made her way from her home in Mariemont to Westwood, where she picked up Barton, who she said wanted a ride to a motel.

“We got lucky and he was in the back of the car,” said Vogelpohl.  “She had no idea, but she led us right to him.”

A Crime Stoppers tip led to the arrest Tuesday of a Cincinnati man who allegedly went on a multi-county credit-card-theft spree.

James Barton, 23, is accused of stealing credit cards from medical facilities in Warren, Butler, Clinton, Montgomery and Hamilton counties and then using them to buy expensive electronics, according to the Warren County Sheriff’s Office.

The cards were stolen from unattended purses of patients as well as employees of hospitals and medical facilities in Mason, Oxford, Kettering, West Chester and Deerfield Township, said Warren County Sheriff’s Detective Susan Horne.

Some of the thefts occurred in what are supposed to be secure areas of the facilities, she said. Barton is not believed to have a job that would give him special access in any of those places, said Horne.

Barton allegedly used the stolen cards to buy expensive electronics in big-box retail stores such as Walmart, Target and Meijer, Horne said.

Investigators believe Barton is responsible for four incidents in Warren County, including thefts from Springdale Mason Pediatrics in Mason.  In Warren County, Barton will be charged with several counts of forgery, misuse of a credit card, receiving stolen property and theft.

Barton is being held at the Hamilton County Jail as “numerous” other agencies in the five counties are compiling criminal charges, said Horne.  Barton may also face charges in Northern Kentucky, she said.

Horne has some advice to other businesses to avoid becoming a victim.

“Employees need to make sure they’re aware of who’s walking around in what are supposed to be secure areas,” she said.
